JETPACK COLLECTIVE STANDARD COMPETITION
TERMS AND CONDITIONS

BACKGROUND:

These Terms and Conditions create an agreement between you and Jetpack Collective (hereinafter referred to by name or as “us”, “we”, “our” or “the Company”). These Terms and Conditions govern your entry into any competition (“the Competition”) for any game published by Jetpack Collective (“the Game”), including any and all related components and documentation.

1. Agreement

1.1 By accepting these Terms and Conditions and submitting your application to enrol in the Competition, you agree to be bound by these Terms and Conditions and hereby enter into a legally binding Agreement with us.

1.2 If you do not accept these Terms and Conditions, you will not be permitted to enrol in the Competition.

2. Interpretation

2.1 Unless the context otherwise requires, each reference in these Terms and Conditions to:

2.1.1 “writing”, and any related expression, includes a reference to any communication effected by electronic transmission or similar means;

2.1.2 a statute or a provision of a statute is a reference to that statute or provision as amended or re-enacted at the relevant time;

2.1.3 “these Terms and Conditions” is a reference to these Terms and Conditions;

2.1.4 a Schedule is a schedule to these Terms and Conditions; and

2.1.5 a Clause or paragraph is a reference to a Clause of these Terms and Conditions; and

2.1.6 a “Party” or the “Parties” refer to the parties to these Terms and Conditions.

2.2 The headings used in these Terms and Conditions are for convenience only and shall have no effect upon the interpretation of these Terms and Conditions.

2.3 Words imparting the singular number shall include the plural and vice versa.

2.4 References to any gender shall include the other gender.

3. Eligibility and Enrolment

3.1 Enrolment is defined per Competition. Any limit on number of entries, or eligibility requirements or assessment is defined per Competition. Requirements for you to be confirmed as a competitor in a Competition. 

3.2 Entrants under 18 years of age must get consent from a parent or legal guardian before enrolling. By enrolling you are confirming that you are either at least 18 years old, or that you have consent from a parent or legal guardian.

3.3 You will be required to provide specific information to enrol, defined per Competition.

3.4 Once you enrol in the Competition we will contact you via Email confirming your enrolment and providing further details of the Competition including all instructions.

3.5 Your enrolment will not be accepted if you do not provide the required information as listed in Clause 3.3.

3.6 Other than personal information which will be dealt with in accordance with the specific games Privacy Policy (defined per Competition), we may use information, including gamer tags/IDs, provided to us in any way we deem appropriate for purposes of marketing and community building including, but not limited to: 

3.6.1 The use, publication, distribution, transmission, or broadcasting of your role and activity in the Competition; and

3.6.2 The creation, use, publication, distribution, transmission, broadcasting, licensing, sub-licensing, leasing, lending and sale of any derivative works based on your role and activity in the Competition.

3.7 Our use of the information provided shall not bestow any rights or interests upon you whatsoever.

          3.8 For your activity to be eligible for the Competition, you must stream your entry.

4. Disclaimer of Warranties and Liability

4.1 The Game may be currently in development and released solely for the purposes of testing. You hereby acknowledge that the Game may not a finished product and as such may contain defects. The Game is provided “as is”.

4.2 We make no representation or warranty that the Game will meet your requirements, be of satisfactory quality, be fit for a particular purpose, be compatible with all computer systems, or will be secure.

4.3 You acknowledge that use of the Game may lead to data loss or other damage to your computer or the data held thereon.

4.4 You acknowledge that your use of the Game is at your own risk.

4.5 We shall not be liable for any direct, indirect, consequential or incidental loss or damage of any kind resulting from or relating to the Game or its use.

5. Competition Period

5.1 The Competition Period is as defined per Competition.

5.2 The Competition may be extended, reduced or terminated immediately at our sole discretion.

6. Competition Rules

6.1 We will use your gamer tag/ID, to determine the winner of the competition based on the game data we gather during the Competition Period.

6.2 The Winner will be as per defined per Competition.

6.2.1 Any restrictions or requirements of play, to quality as Winner, will be defined per Competition.

6.3 The Winner will be selected entirely at the sole discretion of the Company based on the gameplay data during the competition period.

6.4 Winner Notification: The Winner will be notified by email via the account provided at point of entry within 14 days of the closing date and will have 14 days from notification to claim their prize. If the Winner does not claim their prize within this timeframe the promoter reserves the right to withdraw prize entitlement and will award the prize to a reserve selected at the same time as the original.

7. Competition Prize

7.1 Defined per Competition.

8. Software Updates

8.1 We may from time to time during the Competition Period release updates for the Game. You will either be notified by email of their availability and provided with a URL for downloading or the Game will automatically download and install the updates (unless you have disabled automatic updates).

8.2 You are required to install all updates as and when they become available. This enables us to collect up-to-date data on the performance of the Game and any updates that we issue.

9. Support

9.1 No specific technical support is provided for the Game. You are free to submit general enquiries to us via the Game’s Discord server however we are under no obligation to answer them or to provide support for the Game.

10. Reporting and Feedback

10.1 The Game may produce its own error reports and other diagnostic files. You should ensure that, where possible, your computer is connected to the internet and any firewall or other internet security you may have is configured to allow the Game to send such reports and files to us.

10.2 You will from time to time be requested to submit feedback to us. Failure to provide feedback when requested may result in your exclusion from the Competition in accordance with Clause 12.

10.3 You hereby acknowledge that upon submitting feedback to us you automatically grant us a worldwide, perpetual, irrevocable, royalty free licence to use that feedback in any way we deem appropriate including, but not limited to:

10.3.1 The use, publication, distribution, transmission, broadcasting, licensing, sub-licensing, leasing, lending and sale of the feedback; and

10.3.2 The creation, use, publication, distribution, transmission, broadcasting, licensing, sub-licensing, leasing, lending and sale of any derivative works based upon the feedback.

10.4 Our use of the feedback shall not bestow any rights or interests upon you whatsoever.

11. Data Protection

11.1 When submitting your application to enrol in the Competition and when downloading and using the Game you may be required to provide certain personal information including, but not limited to, your name, date of birth and email address. Under certain circumstances we may also obtain details about your computer’s system configuration and its IP and MAC addresses.

11.2 Any data collected by us will be collected, processed and held in accordance with the Company’s rights and obligations arising under the provisions and principles of UK data protection law (including, but not limited to, the UK GDPR, Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003).

11.3 All data collected and held by us will be governed by the specific game’s Privacy Policy, which will be defined per Competition.

12. Termination

12.1 Your enrolment in the Competition shall terminate at the end of the Competition Period.

12.2 We reserve the right to terminate your enrolment in the Competition prior to the end of the Competition Period if you commit a material breach of these Terms and Conditions.

12.3 We reserve the right to terminate the Competition Period in accordance with sub-Clause 5.2.

12.4 Any and all obligations which either expressly or by their nature continue beyond the termination, cancellation or expiration of the Competition Period shall survive termination under this Clause 12.

13. Indemnification

13.1 You hereby acknowledge that you shall be liable for and shall indemnify the Company against any costs, liability, damages, loss, claims or proceedings from any third party which arise out of your use of the Game.

14. Assignment

14.1 You may not assign, transfer, sub-licence, or in any other manner make over to any third party the benefit and/or burden of these Terms and Conditions without our prior written consent, such consent not to be unreasonably withheld.

15. Relationship of Parties

15.1 Nothing in these Terms and Conditions shall create, or be deemed to create, a partnership, the relationship of principal and agent, or of employer and employee between you and the Company.

16. Severance

16.1 In the event that one or more of the provisions of these Terms and Conditions is found to be unlawful, invalid or otherwise unenforceable, that / those provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.

17. Modification

17.1 We may modify or reset the Game, including your progress, inventory, characters, achievements, currency, in-game purchases, virtual items, account or in-game settings and / or modify these Terms and Conditions at any time. In the event that modifications are made, we will publish details of them on Steam and may also send you an email detailing the modifications.

17.2 If you do not agree to be bound by any modified terms and conditions we may introduce, you should immediately inform us that you wish to leave the Competition.

18. Law and Jurisdiction

18.1 These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.

18.2 Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
